Informed Refusal Package
Package includes a sample policy offering guidance on how to balance between the facility’s responsibility to respect a resident’s right to self-determination and the facility’s responsibility to ensure the safest environment possible for residents. When a resident’s / representative’s choice significantly conflicts with the facility’s standard practices or recommended treatment, the facility may consider using an “informed refusal” to mitigate the risks associated with the facility’s decision to respect the resident’s right and to participate in care planning, to refuse treatment, or to make decisions about his/her care and/or activity that may not be consistent with the guidance offered by the facility. Package also include a detailed form regarding the choices that is intended to become part of the resident’s medical record, as well as a decision tree to guide the user through the process.
